Two sentenced on felony charges in Southeast District Court – Jamestown Sun


JAMESTOWN – Two people were sentenced recently on felony charges in Southeast District Court in Jamestown.

Dawn Marie Andracki, 59, Valley City, North Dakota, pleaded guilty to four counts of theft of property, three counts of unlawful entry into a vehicle-commit crime and unauthorized use of personal identifying information, Class C felonies.

Andracki was accused of entering three different vehicles without the use of force with intent to commit a crime, taking one or more debit or credit cards and personal property with an aggregated value of less than $500 from an individual, taking personal property with an aggregated value of less than $500 from another individual, taking tools with an aggregate value of between $1,000 and $10,000 from a business and using an individual’s personal identifying information to obtain money, goods or services from a business on Aug. 14-15.

Judge James Shockman sentenced Andracki to 18 months in the North Dakota Department of Correctional and Rehabilitation with 27 days credit for time served. Shockman placed Andracki on two years supervised probation and ordered her to pay a $400 criminal administration fee, $100 defense/facility administration fee, $1,415 restitution and a $25 victim-witness fee. Andracki also stipulated the return of any and all information, evidence and property to the victims.

A Class C felony is punishable by five years in prison and a $10,000 fine.

Chelsea Annmarie Payne, 38, Jamestown, pleaded guilty to two counts of possession of drug paraphernalia, Class C felonies.

Payne was accused of possessing one or more smoking devices used with methamphetamine on June 17 and Aug. 14 with a previous conviction in 2018.

Shockman sentenced Payne to seven days in the Stutsman County Correctional Center with seven days credit for time served. Shockman also placed Payne on two years supervised probation.
