Property mogul Mutaasa Kafeero sues car dealer over Shs900m Range Rover


The Commercial Division of the High Court in Kampala is set to deliver its ruling on July 10 in a case involving the purchase of the latest model of a Range Rover worth Shs900m.
Court documents show that property mogul Mutaasa Kafeero sued car importer Yassah Matovu Sseguya for allegedly failing to refund him Shs300m following a botched car importation deal.
 
It’s alleged that Mr Mutaasa and Mr Sseguya signed an agreement in which the latter was to sell a 2023 model Range Rover worth Shs900m which was to be paid in instalments. 
Subsequently, Mr Mutaasa proceeded to pay Shs300m as the initial deposit with the balance of Shs600m to be paid in 12 instalments of Shs50m. 

However, having been given the vehicle and making the first instalment, Mr Mutaasa realised the vehicle was a 2022 model and not a 2023 model, contrary to what was agreed upon and consequently, he rejected it.  
Through his lawyers, Muwema & Co. Advocates and Solicitors, Mr Mutaasa said he entered into an agreement with Mr Sseguya to which they agreed that he would take back the car and source for model 2023 or refund the money. 

But having again failed to source for the car, court documents show that Mr Sseguya refunded Shs50m of the Shs350m deposited.
“According to information received from my lawyers, M/s Muwema & Co. Advocates, which information, I verily believe to be true, the parties entered into a sale by description agreement which the defendant/respondent breached and is therefore not entitled to keep the deposit,” reads in part the court documents.

Mr Mutaasa now wants court to determine whether the Range Rover supplied corresponds with the description in the agreement with Mr Sseguya. 
He also wants the court to determine whether or not, he is entitled to a refund of the initial deposit of Shs300m on the car.
