Florida voters reject Amendment 2, blocking proposed agricultural property tax exemption

TALLAHASSEE, Fla. — Florida voters Tuesday rejected Amendment 2, a proposed constitutional amendment that would have exempted qualifying agricultural equipment and other tangible personal property from property taxes.

The proposed constitutional amendment exempting tangible personal property on agricultural land from taxation received 58.21% approval, with 4,542,816 votes in favor and 3,260,736 opposed. However, the measure fell short of the 60% voter approval required for passage.

The proposal would have applied to tangible personal property habitually located or typically present on land classified as agricultural and used in the production of agricultural products or for agritourism activities. The property would have needed to be owned by the landowner or the person or business leasing the agricultural land.

The proposed exemption applied to qualifying personal property, such as farm equipment and machinery, rather than the agricultural land itself.

The amendment would have changed Article VII, Section 3, of the Florida Constitution and first applied to assessments for tax years beginning Jan. 1, 2027.

The exemption would have been subject to conditions and limitations established by the Florida Legislature.

The Florida Legislature placed the proposal on the statewide ballot, allowing voters to decide whether to establish the exemption in the Constitution.

The amendment’s defeat means qualifying agricultural and agritourism equipment will not receive the proposed additional property tax exemption.
