The Pennsylvania Supreme Court has unanimously ruled that game wardens and other government officials generally must obtain a warrant before entering properly posted private land.
According to WJAC news The 7-to-0 decision sided with the Punxsutawney Hunting Club and Pitch Pine Hunting Club in Clearfield County, finding that Pennsylvania’s Constitution provides stronger privacy protections than federal law. The ruling overturns a 2007 state court decision and invalidates portions of the Game and Wildlife Code that allowed warrantless entry onto posted private property.
The court says the protection applies when landowners clearly mark or secure their property to keep others out.
