Private Equity Firm Sues Insurers Over Bankruptcy Litigation


Private equity firm L Catterton sued three insurance companies, alleging they breached their contractual obligations under excess liability policies by refusing to cover legal costs from bankruptcy adversary litigation.

The insurers — units of Liberty Mutual, Argo Group, and Axis Capital — wrongfully denied coverage for defense costs and potential settlement amounts related to the bankruptcy adversary proceedings, Catterton said in a lawsuit Tuesday in the Delaware Superior Court.
